The importance of the subject comes in that the Iraqi constitution took the parliamentary system as one of the political systems based on the principle of separation of powers and what it means from the existence of cooperation and mutual influence between the legislative and executive authorities and the existence of differences between them and that the breach of this balance means the deviation of the parliamentary system in favor of one authority over another and the decisions of the Federal Supreme Court through its jurisprudential role that it exercised began since 2010 on the proposals of laws as the executive authority outweighed at the expense of the legislative authority is It is worth studying for what may be diagnosed from the observations on this jurisprudential role and then develop appropriate proposals to address the problems that result from this jurisprudence, especially since the constitutional judiciary is the one who protects the principle of separation of powers and this principle is the main pillar in the parliamentary system and the cornerstone in the protection of rights and freedoms.
